Since the main and the interim relief sought being one and the same, the Writ Petition itself is taken up for disposal at the admission stage.

In this Writ Petition, the petitioner seeks a direction to the respondents to appoint him as 'Mutawalli' with respect to the wakf institution Dargah Hazarat Shah Jarooh Mastan situated at ShahAli-Banda, Hyderabad. The petitioner asserts that he had made several representations, the latest being the one dated 18.08.2018. Heard learned counsel for the petitioner as well as Sri M.A. Mujeeb, learned Standing Counsel for Waqf and learned Government Pleader for Social Welfare.

Since it is the prerogative of the Waqf Board to consider the eligibility or otherwise of the petitioner to be appointed as 'Mutawalli', in terms of Section 63 of the Waqf Act, 1995, the Writ Petition is disposed of directing the respondent Waqf Board to consider the representations said to have been submitted by the petitioner and take an appropriate decision, subject to the provisions of the 1995 Act and the Rules made thereunder. Consequently, the miscellaneous Applications, if any shall stand disposed of.
