This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction of the second respondent-University in considering the applications of the petitioners, as arbitrary and illegal. 2.
Heard the learned counsel for the petitioners. 3.
The second respondent had issued a Notification dated 06.07.2016 inviting applications from the educational institutions for establishment of Private Veterinary/Animal Husbandry Polytechnic Colleges in the State of Andhra Pradesh. As per the terms and conditions of the notification, the institutions, which are interested to start the Colleges, have to furnish the details about the infrastructural facilities along with the Demand Draft for an amount of Rs.15,000/- and the last date for submission of the applications was 27.07.2016. In pursuance of the notification issued by the second respondent, petitioner Nos.1 to 8 submitted their applications along with the Demand Drafts on 25.07.2016, 26.07.2016, 26.07.2016, 27.07.2016, 25.07.2016, 27.07.2016, 26.07.2016 and 11.07.2016 respectively for commencement of the Private Veterinary/Animal Husbandry Polytechnic Colleges for the academic year 2016-2017.

The contention of the learned counsel for the petitioners is that so far the second respondent has not inspected the infrastructural facilities of the petitioner-Institutions. The fact remains that so far the second respondent has not taken any
decision on the applications of the petitioners. The second respondent alone is competent to decide whether the petitioners have fulfilled all the conditions stipulated in the Notification dated 06.07.2016 or not.

At the time of arguments, the only relief sought for by the learned counsel for the petitioners is to direct the second respondent-University to consider the applications of the petitioners and pass appropriate orders.

In view of the submission made by the learned counsel for the petitioners, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case and also the submission made by the learned counsel for the petitioners, the second respondent is hereby directed to consider the applications of the petitioners dated 25.07.2016, 26.07.2016, 26.07.2016, 27.07.2016, 25.07.2016, 27.07.2016, 26.07.2016 and 11.07.2016 respectively in the light of the Notification dated 06.07.2016 and also in accordance with law as expeditiously as possible.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
