THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25359 of 2015 ORDER:

The petitioner was appointed as a permanent fair price shop dealer of Deergasi-I Depot, Srikakulam Mandal in Srikakulam District. While so, the shop was inspected on 08.11.2014 by the Inspector of Police, Vigilance and Enforcement, Srikakulam, who seized 24 quintals of rice available in the shop alleging that there was a shortage of 4.35 quintals of rice. When the stock was not supplied, the petitioner filed

W.P.No.39392 of 2014 and the said Writ Petition was allowed on 29.12.2014 directing the fourth respondent to issue stock allotment order. Thereafter, the third respondent issued a show cause notice to the petitioner on 22.01.2015 on the same ground of shortage of PDS rice and the petitioner submitted his explanation on 09.02.2015. After receiving the explanation, the authorization of the petitioner was cancelled by order dated 25.04.2015. Against the said order, the petitioner preferred an appeal to the second respondent on 12.05.2015 and when the said appeal is not disposed of till today, the present Writ Petition is filed.

In view of the pendency of the appeal before the second respondent and keeping in view the date of filing of appeal on 12.05.2015, this Court feels it fit to direct the second respondent to consider and dispose of the appeal within a period of thirty days from the date of receipt of a copy of this order by giving due opportunity to the petitioner.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
