THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14347 of 2024 ORDER:

This Criminal Petition is filed under section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of prearrest bail to the petitioners in Crime No.203 of 2024 of Ramadugu Police Station, Karimnagar District. 2.

The brief facts of the case are that the de facto complainant lodged a complaint before the Police stating that her husband, Ramesh, worked as a supervisor at Kaveri Ginning Mill. In 2004, her mother-in-law purchased land in Survey Nos.276/C and 276/D from Pallerla Devika. Recently, they discovered that the land was falsely registered in the name of Singu Hari Babu. When confronted, Pallerla Devika admitted to the false registration. Since then, Singu Hari Babu and his sons have been threatening her family, causing her husband immense mental agony. On 30.10.2024, her husband left home on his motorbike and was later found dead in Ayyavari Kunta. Therefore, she request that action be taken

against Pallerla Devika, Singu Haribabu, and his sons for harassing and threatening her husband, leading to his death. 3.

Heard Sri V. Rohith, learned counsel appearing on behalf of the petitioners as well as Sris Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent.

Learned counsel for the petitioners submitted that the petitioners are arrayed as accused Nos.2 to 4, and the allegations against them are false and baseless and that the petitioners are bonafide purchasers of the property, and the revenue records clearly show their bona fides. He further submitted that the mother-in-law of the de facto complainant had earlier filed a complaint and a civil suit, which were settled amicably and that the de facto complainant has suppressed several facts in the complaint, including the fact that her husband had illicit affairs and matrimonial disputes, which led to his suicide. Learned counsel for the petitioners argued that the allegations of abetment and conspiracy do not attract the ingredients of the offences alleged, and therefore, the petitioners are entitled to pre-arrest bail.

Learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the deceased had written a letter to the Ramadugu Police, requesting action against the petitioners and other accused for harassing him and threatening his family members, therefore, he urged the court to dismiss the criminal petition.

Considering the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the allegations against the petitioners are that accused No. 2 purchased property already bought by the mother-in-law of the de facto complainant, who had lodged a complaint that was later compromised, and also filed a pending civil suit. The petitioners purchased the property with valid registered sale consideration. Although the allegations suggest the petitioners are responsible for the death of the deceased, there is no suicide note. Since the material part of the investigation is completed, this Court deems it fit to grant anticipatory bail to the petitioners with the following conditions:

i.

The petitioners shall surrender before the Station House Officer of Ramadugu Police Station, Karimnagar District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.

ii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
