HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 22996 of 2015 ORDER:
Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.
The petitioner is carrying on business in seeds, pesticides and fertilizers under the name and style of M/s.Parameswara Agencies under a valid licence, which is valid up to 1.2.2016. It appears that the business premises of the petitioner was inspected by the third respondent along with his staff on 9.6.2015 and noticed variation in the stock. After conducting a panchanama, the stocks to the value of Rs.6,92,059/- were seized and 6-A proceedings were initiated against the petitioner. Pursuant to the same, the second respondent issued show cause notice dated 25.6.2015 and the petitioner submitted its explanation. When the seized stocks were directed to be auctioned for distribution to the needy farmers, the present Writ Petition is filed. It is submitted that the petitioner is ready and willing to furnish bank guarantee for the said amount provided the seized stock is released. In the circumstances, the second respondent is directed to release the seized stock belonging to the petitioner on its
furnishing bank guarantee for Rs.6,92,059/-. The petitioner shall renew the bank guarantee from time to time till the conclusion of the 6-A proceedings. In view of this order, the proceedings dated 25.6.2015 are set aside.
The Writ Petition is accordingly disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed. No order as to costs. --------------------------------------------------- JUSTICE A. RAMALINGESWARA RAO DATED 24th JULY, 2015.
