THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38292 of 2016 ORDER:

This writ petition is filed seeking to declare the action of respondents 1 to 4 in not completing the investigation in Crime No.184 of 2013 and not filing the charge sheet, as illegal and arbitrary. Heard and perused the material available on record. The case of the petitioner is that he lodged a complaint to the 3rd respondent against the 5th respondent alleging that the 5th respondent has collected an amount of Rs.6,00,00,000/- from 98 Home Guards including the petitioner, representing that he would get constable jobs to them and as such the 5th respondent cheated the petitioner and others. The grievance of the petitioner is that the 4th respondent has recorded the statements of the petitioner and other witnesses under Sections 161 & 164 Cr.P.C. thereafter, there is no progress in the investigation of the crime and even charge sheet is also not filed. Learned Assistant Government Pleader submitted that the respondent police are investigating into the matter and they are collecting evidence and on completion, the respondent police will file a charge sheet.

Recording the rival contentions, the 4th respondent is directed to complete the investigation in Crime No.184 of 2013, as expeditiously as possible and file a final report, if any, either way in accordance with law. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 8th November, 2016 KL
