THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.12734 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/accused No. 2 in Crime No.735 of 2022, on the file of Shadnagar Police Station, Cyberabad, registered for the offences punishable under Section 20 (b) (ii) (B) of NDPS Act, 1985.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The petitioner is A-2 in the present crime. A-1 preferred Crl.P.No.563 of 2023 and this Court by order dated 03.02.2023 granted bail to A-1, after elaborately discussing the case on the ground of violation of Section 52-A of NDPS Act.

On the ground of parity and also for the reasons mentioned in Crl.P.No.563 of 2023 while granting bail to A-1, the relief of regular bail can be considered, subject to following conditions:

i) The petitioner/accused No.2 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of XIII Additional Metropolitan Sessions Judge, R.R.District at L.B.Nagar.

ii) The petitioner/accused No.2 after release shall appear before the concerned Court on every date of hearing.

iii) The petitioner/accused No.2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
