THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 2553 OF 2016 O R D E R:

This contempt case is filed alleging non-implementation of the order, dated 14.03.2015, passed by this Court in W.P.M.P.No.6028 of 2015 in W.P.No.4548 of 2015. Operative portion of the aforesaid order reads as under: "In that view of the matter, there shall be interim suspension of the proceedings in F.No.61/KHM/2002/Z-III, dated 29.01.2015. However, this order will not preclude the respondent-Wakf Board to take necessary steps for conducting elections and constitute a new Committee in accordance with Section 5 of the Wakf Act and G.O.Ms.No.74, dated 20.11.2010."

Pursuant to the above said order, the Wakf Board issued an election notification on 11.04.2018. Questioning the same, the Managing Committee of Jamia Masjid filed W.P.No.16580 of 2018, in which, the learned Single Judge of this Court vide order, dated 02.05.2018, refused to grant interim order. Aggrieved by the same, the Managing Committee filed W.A.No.758 of 2018 and the Division Bench of this Court by holding that the existing Managing Committee is entitled to hold the Office till 20.11.2018, disposed of the above said writ petition and the writ appeal vide common judgment, dated 07.06.2018.

In view of the above, it is not possible for the respondent to implement the order, dated 14.03.2015, passed by this Court. Hence, this Court does not find any contempt on the part of the respondent.

The contempt case is accordingly closed.

Consequently, miscellaneous applications, if any shall stand closed.
