THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.18128 of 2016 ORDER:

It is the case of the petitioner that on 28.05.2015, a notification was issued by the second respondent in Sakshi Telugu News Paper inviting applications from the interested qualified persons for the post of Umpire. It was restricted to the persons having less than 40 years of age. He attended the coaching classes. Out of 52 persons appeared, only 13 persons were selected and the petitioner is one among them. All the qualified candidates were informed that a screening test would be conducted. At the time of giving such information, the petitioner was aged about 39 years 10 months. The screening test was conducted on 09.01.2016 and results were declared and name of the petitioner was shown at Sl.No.21. When he was not allowed to appear for Level-I main examination, he filed the present writ petition.

A counter-affidavit is filed stating that the petitioner crossed the age of 40 years as on 01.09.2015 and accordingly, he was not allowed for Level-I main examination. The first

ARLR, J W.P.No.18128 of 2016 respondent addressed a letter to the second respondent on 05.12.2015 stating that the Level-I Umpires Course would be conducted during February 2016 and the second respondent was directed to select not more than 25 Umpires who are less than 40 years of age as on 01.09.2015. Accordingly, selections were made.

As per the papers filed along with the writ petition, the date of birth of the petitioner is 02.11.1975. He completed the age of 40 years by 01.11.2015. The Level-I main examination was scheduled on 21st February 2016 and by that time, the petitioner already completed 40 years of age. In view of the same, the action of the respondents in not allowing the petitioner to attend Level-I main examination cannot be found fault with. The writ petition is accordingly dismissed.

Consequently, Miscellaneous Petitions, if any pending in this Writ Petition shall stand closed. No order as to costs. _____________________________ A.RAMALINGESWARA RAO, J 6th SEPTEMBER, 2016.
