THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.30727 OF 2018 ORDER :

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Services-I for learned Government Pleader for Education.

Aggrieved by the order dated 31.10.2017 passed by the 2nd respondent, imposing punishment of withholding of one annual grade increment without cumulative effect, petitioner preferred appeal on 10.11.2017. Alleging inaction on the said appeal and on the contrary not granting promotion to the petitioner, this writ petition is filed.

As of now, petitioner is under currency of punishment. Aggrieved by the order of punishment, appeal is preferred and the same is pending.

In view of the facts noted above, this Court is not inclined to entertain the writ petition at this stage.

Accordingly, the Writ Petition is disposed of directing the appellate authority to pass orders on the appeal preferred by the petitioner on 10.11.2017, as expeditiously as possible, preferably within a period of four (4) weeks from the date of receipt of copy of this order. In the event petitioner succeeds in the appeal, he is entitled to promotion on par with his juniors who may have been promoted in the meantime. Pending miscellaneous petitions, if any, shall stand closed.
