Managing Committee Jamia Mosque And Madeena Mosque v. The State Of Andhra Pradesh

HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 30748 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the second respondent in not constituting the Managing Committee to a notified Wakf, known as, Jamia Mosque and Madeena Mosque, Bathalapally Village and Mandal, Anantapur District, in spite of the representation submitted by the petitioner-Managing Committee, dated 27.02.2018, as illegal and arbitrary. 2) At the time when the matter is taken up for hearing, learned counsel for the petitioner states that the Wakf Board is likely to appoint the Managing Committee as suggested by the local M.L.A., in his letter dated 07.08.2018. The same is strongly refuted by the learned Standing Counsel for the Respondents, stating that the letters of this nature come to the Wakf Board regularly, and Constitution of Managing Committee basing on such recommendation letters would not arise. He submits that the appointment of Managing Committee will be in accordance with law.

3) Recording the said statement, the Writ Petition is disposed of directing the Wakf Board to follow due process of law in appointing the Managing Committee of Jamia Mosque and

Madeena Mosque, Bathalapally Village and Mandal, Anantapur District.

4) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
