THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13914 OF 2025 ORDER :

This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, by the petitioner/Accused seeking anticipatory bail in connection with Cr.No.1579 of 2025 of Gachibowli Police Station, Cyberabad District. The offences alleged against the petitioner are under Section 69 of Bharatiya Nyaya Sanhita, 2023.

The case of the prosecution is that the complainant lodged a report before police stating that in September 2023, she visited Hema Clinic in Gowlidoddi due to health issues, where she met the petitioner. They exchanged phone numbers, and the petitioner expressed his intention to marry her. Believing his words, she went to lunch with him on 24.10.2023 at his uncle's house in Gowlidoddi. There, he attempted to become physically intimate with her. Although she initially resisted, he emotionally persuaded her with manipulative words. Later, in 2024, they met at SS Inn Hotel in Gachibowli, where they exchanged rings as a symbol of their commitment. They again became physically intimate on the same day.

- 2 - However, over the past six months, the petitioner began avoiding her. When she confronted him, he said his parents would not accept their marriage and advised her to end the relationship. He then blocked her number. It is further stated that when she approached the police to file a complaint, the petitioner's mother came to the police station and requested seven months time to resolve the matter. Despite this, the petitioner later clearly stated that he would not marry the complainant and had deceived her. Based on her complaint, the police registered a case against the petitioner. 3.

Heard Dr.J.Vijayalaxmi, learned counsel appearing for Sri J.Krishna, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for respondent-State.

The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations. The petitioner intended to marry the complainant under the bonafide impression that complainant is an unmarried woman. However, while negotiating with her family members, he came to know that she is already married and the marital relationship with her husband is still subsisting. As such, he requested for

- 3 - clarification and suggested her to take divorce with her husband, so that they can get married. Hearing these words the complainant got angry and filed this false case against the petitioner. Hence, prayed this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the allegations against the petitioner are heinous in nature and there is no such investigation with regard to first marriage of complainant. Therefore, prayed this Court to dismiss this petition.

Considering the submissions made by both the counsel and the material on record it is seen that engagement was already performed between the parties, whereas the contention of petitioner is that earlier marriage of complainant is still in subsistence and she has to separate from her husband, so that he can marry her. Considering the allegations and the facts and circumstances, the custodial interrogation of the petitioner is not required in this case. As such, this Court deems it fit to grant anticipatory bail to the petitioner subject to the following conditions :

The petitioner/Accused shall surrender before the Station House Officer, Gachibowli Police Station, Cyberabad within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner on bail on his executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for the like sum each.

ii.

The petitioner/Accused shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight

(8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/Accused shall abide by the other conditions stipulated in Section 482(2) of BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
