ORAL ORDER:

Petitioner was suspended by order dated 17.1.2017 by the Assistant Commissioner of Endowments. Aggrieved thereby, he preferred appeal before the Commissioner. However, Court noticed that there was no proof of filing of appeal, therefore permitted petitioner to send copy of appeal stated to have been filed on 17.3.2017 within one week to the Appellate Authority and Appellate Authority was directed to examine the claim of the petitioner and take a decision within a period of four weeks thereon. Alleging disobedience of the said order, this contempt case is filed.

Learned Government Pleader produced copy of proceedings Rc No.A1/COE-11025(43)1/2017-A dated 22.8.2017 whereunder, Commissioner on due consideration of the appeal preferred by petitioner, revoked the suspension and simultaneously imposed punishment of stoppage of three increments without cumulative effect. In view of the orders passed by the Appellate Authority on 22.8.2017, it cannot be said that orders of this Court are not complied with. Accordingly, contempt case is closed, leaving it open to the petitioner to workout remedies as available to him under law, if so advised, against the decision of the Commissioner.
