THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.30771 of 2018 ORDER:

The complaint of the petitioner in the present Writ Petition is that despite submitting a number of representations, including one on 07.05.2018, to the Commissioner of the respondent-Nagara Panchayat/respondent No.3 against the constructions being undertaken by the unofficial respondents, no action has been taken so far.

On the other hand, it is submitted by Sri Md.Saleem, learned Standing Counsel for the respondent-Nagara Panchayat, on instructions, that no such representation has been received by the 3rd respondent.

On hearing the same, a request is made by the learned Counsel for the petitioner that the petitioner may be permitted to submit a fresh representation to the 3rd respondent for consideration and for taking appropriate action. Having heard the learned Counsel for the petitioner and the learned Standing Counsel, this Court deems it appropriate to dispose of the Writ Petition, leaving it open for the petitioner herein to submit an appropriate representation, afresh, within a period of one week from the date of receipt of a copy of this Order, and if any such representation is made by the petitioner herein, within the time stipulated above, the respondent-authorities are directed to consider the same and take further action, strictly in accordance with law, as expeditiously as possible, after giving notice to all the stakeholders.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed. No costs.
