The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the inordinate delay on the part of the third respondent in conducting the conciliation proceedings over the charter of demands of the petitioner Union, particularly with reference to the prohibition of employment in the establishment of respondent No.1 in the operation and maintenance of external coal handling system consisting of 9.8 kms. Long bi-cable aerial rope way system having rated transport capacity of 300 MT/ hr of coal and associated systems like belt conveyers, electrical instrumentation and control system, fire protection system etc., including critical maintenance works of rope way system, as illegal and arbitrary.

It is represented by the learned counsel for the petitioners that already a reference has been made to the second respondent and hence nothing survives for adjudication in the present writ petition. The same is not disputed by the learned counsels appearing on behalf of the respondents. 4.

Having regard to the above, the writ petition is closed with a direction to the second respondent to take steps in accordance with law, as early as possible, preferably within a period of eight (08) weeks from the date of receipt of a copy of the order. No costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed.
