HON'BLE SRI JUSTICE S.V. BHATT W.P.No.29292 OF 2013 ORDER:

The petitioners pray for Mandamus declaring the inaction of 1st respondent in considering the appeal filed by the petitioners on 14.05.2013 under Sections 72 and 73 of the Registration Act for the property covered by door No.12-3-342 in Sy.Nos.54 and 55 of Syed Ali Guda, Gudimalkapur, Hyderabad, as illegal and amounts to refusing to exercise the statutory authority conferred on the 1st respondent.

At the time of hearing, the learned Government Pleader places before the Court the order of the 1st respondent dated 05.09.2014 in Lr.No.9/2269/2013. Having regard to the order dated 05.09.2014, the cause of action in the writ petition does not survive. The writ petition is, accordingly, dismissed. The petitioners are at liberty to assail the order dated 05.09.2014 in a properly instituted case. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
