HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.31452 of 2015 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Revenue.
The petitioners were already figured as respondents 4 and 5 in W.P.No.4707 of 2008 and batch, which was disposed of on 05.09.2012 with the following directions:
"Accordingly, all the Writ Petitions are allowed quashing the resumption order dated 09.02.2008, passed by the Revenue Divisional Officer, SPSR Nellore District. The official respondents are at liberty to initiate fresh resumption proceedings after putting the petitioners and impleaded respondents on notice. Till the conclusion of the resumption proceedings, there shall be status quo existing as on this day with regard to possession of the property. No costs."
The present Writ Petition is, however, filed by the petitioners stating that in terms of the said orders, no steps are being taken by the respondents for resumption of the land and on the allegation that the Tahsildar, Nellore Mandal, SPSR Nellore District, the 4th respondent, and his subordinates are threatening the petitioners and apprehending dispossession, the present Writ Petition is filed. In my view, the petitioners herein were already heard in the earlier Writ Petition and after considering the batch of Writ Petitions, this Court passed the above said order. It is clearly stated in the said order that till conclusion of the resumption proceedings, there shall be status quo existing as on that day with regard to the possession of the property.
today and there is no reason to entertain the present Writ Petition, particularly as the petitioners are seeking a direction in contravention of the orders passed in the earlier Writ Petition. Hence, no relief as sought for can be granted to the petitioners. The Writ Petition is, accordingly, dismissed. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
