HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.30797 OF 2018 ORDER :
This writ petition is filed challenging the action of the respondents 2 and 3 in interfering with the civil disputes of the petitioner under the guise of the case in Crime No.42 of 2018 on the file of the 3rd respondent, filed by the 5th respondent against her husband i.e. 4th respondent and his family members, and in insisting the petitioner to vacate the leased premises to an extent of 351 Sq.yards in RS.No.758/1 of Koppka Village, Pedavegi Mandal, West Godavari District, before expiry of lease period i.e. 30.04.2032, as illegal and arbitrary.
Learned Assistant Government Pleader for Home produced written instructions stating that the 5th respondent gave complaint against her husband i.e. 4th respondent and the same was registered in Crime No.42/2018, dated 02.07.2018 under Sections 498(A), 326, 506, r/w.34 IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961, and investigation is also taken up; that the petitioner is not the accused in the above said crime; and that they are not interfering with the civil disputes pending between the petitioner and 4th respondent. It is also stated that the respondent police never insisted the petitioner to vacate the leased premises at any point of time.
Recording the aforesaid written instructions submitted by the learned Assistant Government Pleader, the writ petition is disposed of directing the respondent police not to interfere with the civil disputes between the petitioner and 4th respondent. No order as to costs.
