HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.15995 of 2016 ORDER :

All the three petitioners herein are seeking Mandamus to declare the action of 2nd respondent in attempting to dispossess them from their lands to an extent of 5 acres each, which they claim, have been given under patta as they are Ex-Servicemen, without following due process of law or the procedure contemplated under the Land Acquisition Act, as illegal and arbitrary. Interim relief is also sought by filing application in W.P.M.P.No.19778 of 2016.

Learned counsel for petitioners has drawn the attention of this Court to the pattadar passbooks issued in the names of the petitioners. Learned counsel submits that though no notices are issued to the petitioners, there is a threat of dispossession.

Since the main complaint is that in violation of the procedure contemplated under the Land Acquisition Act, attempt is being made by respondents to dispossess the petitioners. The writ petition is disposed of directing the respondents to follow the due process of law for evicting the petitioners from the lands in question, if they intend to acquire the lands belonging to the petitioners. No order as to costs.

As a sequel, pending miscellaneous applications, if

any, shall stand closed.
