HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.30750 of 2018 ORDER:
Aggrieved by the action of the 2nd respondent vide RC No.B2/1485/2018, dated 18.08.2018, this Writ Petition is filed. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for respondents.
Both the learned counsel tried to argue the case on merits, but the order impugned in this writ petition is passed by the revisional authority under Section 9 of the Records of Rights Act, 1971 is bereft of reasons as it is not a speaking order and that only on the ground of violation of principles of natural justice, the same is liable to be set aside.
In view of the same, without expressing any opinion on the merits of the case, the impugned order is set aside and the matter is remitted back to the revisional authority and the revisional authority is directed to dispose of the revision within a period of three months from the date of receipt of a copy of this order. Accordingly, this Writ Petition is allowed to the extent indicated above.
There shall be no order as to costs.
Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
