HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 30834 of 2018 ORDER:

1) Heard learned counsel for the petitioner and Government Pleader for Revenue (TG). With the consent of both the parties, the main writ petition is being taken up for disposal at the admission stage itself.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the fifth respondent in not issuing cheques for agriculture investment input subsidy to the petitioners as per the decree in O.S.No.38 of 2014, dated 22.03.2016 on the file of the Senior Civil Judge, Shadnagar, Mahabubnagar District, as arbitrary and illegal. 3) There is no necessity to put the unofficial respondents on notice as this Court is not venturing to adjudicate the issue on merits.

4) Learned counsel for the petitioner would submit that initially he made an application on 04.05.2018 to the Tahsildar, but the Tahsildar did not take any action. Subsequently, the petitioner claims to have made a representation before the third respondent on 02.07.2018 in Prajavani, in which the Joint Collector made an endorsement directing the Tahsildar to take necessary action. Though the endorsement was made on 02.07.2018, till date no steps are taken by the Tahsildar.

5) The Government Pleader for Revenue (TG) would submit that the decree, which is passed is only a preliminary decree passed by the Civil Court. He further submits that the material placed before the Court does not indicate as to whether any appeal is filed against the preliminary decree and also any interim orders passed in the said appeal.

6) Having regard to the above, the fifth respondent-Tahsildar shall deal with the representation made by the petitioner by taking into consideration the orders passed by the Civil Court and pass appropriate orders in accordance with the provisions of law, as expeditiously as possible, preferably within a period of twelve

(12) weeks from the date of receipt of the order. No order as to costs.

7) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
