THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL MISCELLANEOUS APPEAL No.896 of 2018 JUDGMENT:

This appeal is filed under Order 43 Rule 1 CPC assailing the orders dated 20.07.2018 passed in I.A.No.313 of 2017 in I.A.No.3447 of 2017 in O.S.No.695 of 2017 on the file of the Court of Chief Judge, City Civil Court, Hyderabad.

At the time of arguments, both counsel submitted that I.A.No.3447 of 2017, which is filed under Order 39 Rules 1 and 2 CPC, is pending before the trial Court. Learned counsel for the appellant submitted that the trial Court may be directed to dispose of I.A.No.3447 of 2017 as expeditiously as possible. 3.

In view of the submission made by the learned counsel for the appellant, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case, the learned Chief Judge, City Civil Court, Hyderabad, is hereby directed to dispose of I.A.No.3447 of 2017 as expeditiously as possible, preferably, within a period of two months from the date of receipt of copy of this order.

With the above observation, the Civil Miscellaneous Appeal is disposed of. As a sequel, miscellaneous petitions, if any, pending in this appeal shall stand closed.
