THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.41679 OF 2015 ORDER:

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not fixing the pay of the petitioner by taking continuity of service while fixing the pay in the revised pay scales as illegal, arbitrary and contrary to the Circular No.89/92 issued by the Corporation.

2. Heard Sri Y.Subba Rao, learned counsel for the petitioner and Sri P. Durga Prasad, learned Standing Counsel for respondent-Corporation.

3. Though various grounds have been raised in the writ petition, learned counsel for the petitioner restricts his claim seeking a direction to the respondent-Corporation to consider the representation, dated 06.11.2015, made by the petitioner for fixation of pay in accordance with Circular No.89/92, dated 08.09.1992, and in pursuance of I.D.No.48 of 2010, dated 15.07.2013, at the earliest.

4. Learned Standing Counsel for respondents did not dispute the same.

5. Having regard to the circumstances stated above and without going into the merits of the case, the Writ Petition is disposed of directing the respondentCorporation to dispose of the representation, dated 06.11.2015, made by the petitioner seeking fixation of pay as per Circular No.89/92, dated 08.09.1992 in pursuance of the Award, dated 15.07.2013, passed by the Labour Court in I.D.No.48 of 2010 at the earliest preferably within a period of eight (08) weeks from the date of receipt of a copy of this order.

Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
