THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.1279 OF 2017 ORDER:

This contempt case is filed alleging non-compliance with the order, dated 13.03.2017, passed in W.P.No.33222 of 2017, and the operative portion of the same is as follows.

"In the circumstances, liberty is given to the petitioner to submit a representation to the Commissioner of Police, Warangal with regard to the alleged inaction of the 4th respondent in not registering the complaint under proper sections. As and when such representation is received from the petitioner, the Commissioner of Police shall take necessary action, in accordance with law."

When the petitioner filed the present contempt case, a counter affidavit is filed stating that none of the witnesses, whose statements were recorded, corroborated the allegations in the complaint. Accordingly, the closure report was submitted to the Court concerned. In spite of the said counter affidavit, when the learned counsel for the petitioner stated that the averments are not correct, this Court called for the record from the concerned Police Station and verified the statements of the witnesses. The statements supported the version mentioned in the counter affidavit. In view of the same, this Court does not want to proceed further in the contempt case. However, it is open to the petitioner to take appropriate action in accordance with law.

The contempt case is accordingly closed.
