THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.17056 of 2015 ORDER:

The grievance of the petitioner in this case is as to the refusal by the registration authorities to receive and register the document presented by him relating to certain land in Survey No.521/2 of B.K.Palli Village, Madanapalle

Mandal, Chittoor District. This refusal is stated on the ground that the land in the survey number is being treated as Government land. A similar refusal by the Registration Authorities fell for consideration before this Court in W.P.No.13188 of 2012. Perusal of the order dated 27.04.2012 passed therein reflects that this Court disposed of the writ petition with certain directions. In the light of the aforestated order and for reasons alike as were mentioned therein, this writ petition is disposed of leaving it open to the petitioner herein to file an application before the District Collector, Chittoor District, 2nd respondent, with a request to delete the land in Survey No.521/2 from the list of Government lands duly enclosing the documents pertaining to the said land.

If the 2nd respondent comes to the conclusion that the land is neither owned by the Government nor was assigned to anyone, he shall direct the deletion from the list communicated to the 4th respondent. In such an event, the 4th respondent would be under obligation to entertain the document that may be presented by the petitioner in respect of the said land. This exercise shall be completed within a period of three months from the date of presentation of the application by the petitioner. Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
