HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.14700 of 2016 ORDER:
This writ petition is filed by the petitioner to declare the action of the 2nd respondent in not considering and passing appropriate orders in the appeal and stay petition dated 16.04.2016 and the order of the 3rd respondent dated 28.03.2016 suspending the authorization of the petitioner is illegal and arbitrary.
The case of the petitioner is that he was appointed as fair price shop dealer of Shop No.15 of Manginapudi Village, Donakonda Mandal, Prakasam District. On 05.03.2016, the Food Inspector and with his staff inspected the fair price shop of the petitioner and found certain irregularities. Basing on the panchanama, the 3rd respondent initiated 6-A proceedings and suspended the authorization of the petitioner by the impugned order dated 29.03.2016.
Challenging the order dated 29.03.2016, the petitioner filed appeal along with stay petition on 16.04.2016 before the 2nd respondent. The grievance of the petitioner is that till date no orders are passed in the appeal or in the stay petition. Hence, this writ petition.
Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies.
In the facts and circumstances of the case, since the appeal preferred by the petitioner is pending before the 2nd respondent, the 2nd respondent is directed to consider the same and pass appropriate orders, as expeditiously as possible, preferably within a period of four weeks from today.
With the above direction, the writ petition is disposed of.
Miscellaneous petitions pending, if any, shall stand closed. No costs.
