THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.30815 of 2018 ORDER:

In the present Writ Petition, the petitioner herein questions the alleged inaction on the part of R.2 in removing the construction made in H.No.15-8-353/354 at Feelkana, Begum Bazar, Hyderabad.

When the matter is taken up, it is submitted by Sri N.Ashok Kumar, learned Standing Counsel for the respondent-Municipal Corporation that earlier the tenants of the petitioner herein filed W.P.No.25692 of 2016 and this Court on 01.08.2016 passed an interim order in WPMP No.31755 of 2016 directing the respondentCorporation not to proceed, in any manner, for causing demolition of the building bearing No.15-8-353 & 354, Feelkhana, Hyderabad. It is not in dispute, even according to the learned Counsel for the petitioner, that the said order is still subsisting. It is also significant to note that in the said Writ Petition, the petitioner herein is arrayed as R.3. Therefore, the present Writ Petition, in the considered opinion of this Court, is not maintainable before this Court.

For the aforesaid reasons, the Writ Petition is dismissed, however, it is open for the petitioner herein to pursue the above said W.P.No.25692 of 2017. There shall be no order as to costs. Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
