HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.6291 OF 2016 ORDER:

This writ petition is filed to declare the in action of respondents 2 and 3 in taking appropriate action on the representations dated 15.02.2016 and 11.02.2016 of the petitioner by directing the 4th respondent to take steps to execute the works approved by the Mandal Praja Parishad Committee, Konakanamitla Mandal, Prakasam District vide resolution dated 08.02.2016 with the 13th Finance Funds, as illegal, arbitrary and contrary to the Panchayat Raj Act. As can be seen from the affidavit which has been filed by the petitioner, it is the case of the petitioner that 13th Finance has allocated a sum of Rs.26 lakhs and the same has not been spent for the purpose for which it has been allocated. On account of negligence of the respondents in taking action with respect to providing basic facilities in schools and for solving drinking water problem, the villagers are suffering. As a matter of fact, many of the works have been stopped in the half way through.

Learned counsel for the petitioner submits that he made representation on 15.02.2016 to the notice of the 2nd and 3rd respondents, but nothing has been done by them. Hence, this writ petition.

Learned standing counsel appearing for respondents submits that as the financial year is coming to an end, it is not possible at this stage to complete the works, as the works involve some time for execution. If they are not taken up at the fag end of the financial year, they would be taken up in the next financial year and would be completed.

Having considered the submissions of both counsel without expressing any opinion in respect of submissions, the writ petition is disposed of with a direction to respondents 2 and 3 to take into consideration of the representation made by the petitioner dated 15.02.2016, particularly in relation to the terms, which have been highlighted and to act upon the representation by taking necessary steps to redress the grievance. It is needless to mention that the respondent authorities shall keep in mind the proper utilization of the funds allocated and shall not leave the works in half way merely because the financial year is coming to an end, as that would be only flittering away the public money. There shall be no order as to costs. In view of the disposal of the main writ petition, Miscellaneous petitions, if any pending in the writ petition, shall also be closed.
