2016-01-20Vilas V.Afzulpurkar2 pages

HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.1497 of 2016 ORDER:

Heard.

The petitioner claims that he holds a General Power of Attorney with respect to the land admeasuring Ac.5-00 cents in Sy.No.159/2B/3B situated at Rapthadu Village and Rural Sub-Division, Anantapur District and alleging that the 2nd respondent is entertaining the document from third parties for registration in respect of the land covered by the petitioner's document and objections sought to be filed by the petitioner are not entertained by the 2nd respondent, the present writ petition is filed. Even accepting the contention of the petitioner, I do not find any provision under the Registration Act under which the 2nd respondent can entertain any objections with regard to third parties documents presented for presentation. Hence, even if the petitioner holds any interest in the property claimed, he has to take appropriate recourse by approaching competent civil court. However, he cannot object for registration of a document of third parties.

Hence, with the liberty aforesaid, the writ petition is dismissed. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
