ORAL ORDER:

This writ petition is filed seeking the following relief: ".........to issue writ or order or direction more particularly one in the nature of writ of mandamus declaring the inaction of the respondents in considering the legal notice dated 10.7.2018 and trying to release the VRS benefits to the respondent No 4 and to providing the employment to the son of the second wife of fourth respondent while pending DVC No 117/2015 on the file of I Addl JFCM Karimangar and OS 4/2016 on the file of Family court Judge at Karimnagar as arbitrary and illegal consequently direct the respondents 2 and 3 not to release the VRS benefits to the 4th respondent till the disposal of the DVC and suit and to and to pass...."

Reading of the relief itself would show that 4th respondent/husband of petitioner is intending to nominate his alleged second wife to receive benefits and also intending to propose name of son of alleged second wife for employment. In other words, so far, no such request was made by the employee. Further, petitioner has already instituted DVC No. 117 of 2015 on the file of I Additional JFCM, Karimnagar and O.S. No. 4 of 2016 on the file of Family Court, Karimnagar regarding her grievances against her husband, and the same are pending. If petitioner has any other grievance against her husband, it is open for her to workout her remedies in the pending cases. However, no such direction can be given to the employer not to accept any nomination or request to provide employment on compassionate grounds, if it is otherwise valid. 3.

Accordingly, the writ petition is dismissed, leaving it open to the petitioner to workout remedies available in law. No costs.
