THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2256 OF 2016 ORDER:

This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.619 of 2015 on the file of the Additional Judicial Magistrate of First Class, Gudivada, Krishna District.

Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Sections 138 and 142 of the Negotiable Instruments. It is the case of the petitioner that her husband executed promissory notes and that the petitioner lodged a complaint before the police alleging that cheques were stolen by somebody and subsequently, the present complaint was lodged. The truth or otherwise of the grounds raised by the petitioner cannot be decided by this Court by exercising the powers under Section 482 Cr.P.C. and therefore, this Court is not inclined to interfere with the proceedings in the above C.C. However, the presence of the petitioner before the trial Court is dispensed with, except on the dates when her presence is specifically required by the trial Court. The petitioner shall be represented by her Counsel before the trial Court on all hearing dates.

Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
