THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE DR JUSTICE SHAMEEM AKTHER WRIT PETITION NO.7105 OF 2017 ORDER: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} The relief sought for in this Writ Petition is to declare the tender-cum-auction notice dated 31.01.2017, as arbitrary and illegal.

The auction notice stipulated the last date for conduct and the time of opening tender as 03.03.2017, and the date and time of auction as immediately after completion of the tender opening process in the same premises.

Sri P.Rajesh Babu, learned Standing Counsel for Karur Vysya Bank Ltd., on instructions, would submit that no auction was held on that day; and the respondent-Bank would issue a notification afresh to conduct auctions.

It is evident, therefore, that the cause in the Writ Petition no longer survives, and the Writ Petition has become infructuous. Leaving it open to the petitioner, if they are so aggrieved, to question the validity of any fresh auction notice, if and when issued by the respondent-Bank, the Writ Petition is dismissed as infructuous.
