HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SRI JUSTICE U. DURGA PRASAD RAO W.P. No. 25356 of 2009 JUDGMENT:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This writ petition is filed by the Government assailing the Common Order dated 13.05.2009 in O.A.No. 1501 of 2009 (1366 of 2009 and batch) passed by the Tribunal, whereby the O.A. filed by the petitioner was allowed.

The learned Government Pleader for Services appearing on behalf of the petitioners submits that the Government filed four similar writ petitions i.e. W.P.No. 23029 of 2009 and batch challenging the impugned Common Order dated 13.05.2009 passed by the Tribunal, and this Court, by Common Order dated 18.01.2010, allowed those writ petitions by setting aside the order of the Tribunal relating to O.A.No.1366 of 2009 and batch. He further submits that the present petition filed by the Government is squarely covered by the Common Order dated 18.01.2010 in W.P.No. 23029 of 2009 and batch.

In view of the above submission and following the Common Order dated 18.01.2010 in W.P.No. 23029 of 2009 and batch passed by this Court, the present writ petition is allowed in terms thereof, and consequently, the impugned Common Order dated 13.05.2009 in O.A.No. 1501 of 2009

SKK,J & UDPR,J WP_25356_2009 (1366 of 2009 and batch) is hereby set aside. No order as to costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
