THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT CIVIL REVISION PETITION No.2353 of 2016 ORDER:
While withdrawing the present petition, learned counsel for the petitioner on instructions has prayed that the petitioner may be permitted to remain in the property in question for 9 months for the reason that her two daughters are in the family way and one of them is at the advanced stage.
Permission as sought for is accorded.
Accordingly, this Civil Revision Petition is dismissed as withdrawn.
The vacation order is of dated 12.02.2016 and till date the petitioner is occupying the same and seeking further 9 months time to vacate the premises in question.
As agreed by the learned counsel on instruction that the petitioner will vacate the premises on or before 30th April, 2017 and she shall pay the rent @ Rs.2,500/- per month from February 2016 till the date of vacation.
It is made clear that the petitioner shall pay arrears from February 2016 till July 2016 within one month from today; and thereafter shall continue to pay the rent @ Rs.2,500/- per month till the date of vacation of the premises. I further make it clear that if the petitioner fails to clear the arrears within the time granted by this Court, or fails to pay the monthly rent, the concession granted to her shall stands vacated.
There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this revision petition shall stand
dismissed.
