THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.30942 of 2018 ORDER :

Pursuant to the employment notification No.5/2017 issued by the Singareni Collieries Company Limited to recruit to the post of Electrician Trainee, the petitioner applied by claiming his social status as belonging to S.C and enclosed S.C certificate. The last date for submission of the applications was 25.09.2017. The petitioner converted to Christianity on 28.05.2018 and thereafter applied for issuance of social status certificate on 07.06.2018. He was, accordingly, granted B.C-C certificate. Armed with the said certificate, the petitioner now claims that he should be treated as a person belonging to B.C-C and be considered in the selection process.

As briefly noted above, when the petitioner applied, his social status was S.C and, admittedly, he changed his social status much later to the last date prescribed for submission of the applications. Learned counsel for the petitioner sought to place reliance on the notice issued by the Singareni Collieries Company Limited on 29.07.2018 giving option to the candidates to inform the change of their social status and, therefore, contended that the request made by the petitioner for change of social status is valid.

On a bare perusal of the note appended to the table containing the list of candidates selected, it is clear that candidates can apply for change of description of the social status, only if they have wrongly mentioned against their names when they applied. In the case on hand, as noted above, there was no wrong mention of social status of the petitioner. The social status initially claimed by the petitioner was S.C based on the certificate issued to him and only later he changed the social status.

As the said clause does not come to the rescue of the petitioner, this Court does not find any illegality in treating him as a candidate belonging to S.C in the said recruitment process and he cannot mandate the respondents to treat his social status as belonging to B.C-C based on the caste certificate obtained much later.

Therefore, there is no merit in the writ petition and it is, accordingly, dismissed. Pending miscellaneous petitions, if any, shall stand closed.
