This Criminal Petition is hled under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P'C") seeking regular bail to the petitioner/ accused in C.O.R.No. 174 of 2023, on the lile of Shadnagar Excise Station, Cyberabad, registered for the offence punishable under Sections 8 (c) r/w 22 (C) of NDPS Act, 1985. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent- State and perused the record.

The petitioner was found in possession of 750 gms of alprazolam while he was travelling on a bike. Having followed the procedure prescribed under NDPS Act, the petitioner was remanded to judicial custody.

Learned counsel appearing for the petitioner would submit that there is delay of 7 days in sending the samples to FSL.

l.earned Additional Public Prosecutor opposed the bail application.

Since the case is under investigation, this Court is not inclined to grant the relief of bail at this juncture 7.

Accordingly, the Criminal Petition is dismissed. However, the petitioner is at liberty to renew the application under changed circumstances. Miscellaneous applications, pending if any, shall stand closed.
