THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 30910 of 2018 ORDER:

It is the case of the petitioner that he is the owner of agricultural land to an extent of about Acs.20.00 guntas in Survey Nos.323/A, 3423/AA, 323/E and 324 situated at Kothuru Village, Patwaringudem Panchayat, Dammapeta Mandal, Bhadradri District. It is his further case that respondents 5 and 6 along with some others have tried to interfere with his peaceful possession and enjoyment of the subject land, as such, he filed O.S.No.492 of 2016 for perpetual injunction, along with I.A.No.541 of 2016 for temporary injunction against them, in the Court of Sub-Divisional Magistrate & Special Assistant Agent to Government, Mobile Court, Bhadrachalam, which in turn, granted interim injunction vide order, dated 26.12.2016.

It is his grievance that in spite of the said injunction order is subsisting, respondents 5 and 6 along with some others came to the subject land on 24.08.2018 and tried to beat him with sticks and deadly weapons and therefore, he approached respondent No.4 - Station House Officer, Dammapeta Police Station, Bhadradri Kothagudem District, for lodging a complaint against respondents 5 and 6, but, respondent No.

CKR, J WP.No.30910 of 2018 same by advising him to settle the matter with them. Hence, he filed the present Writ Petition.

Heard learned counsel for the petitioner.

Learned Government Pleader for Home, on instructions, submits that no complaint has been lodged by the petitioner before the police and that if the petitioner lodges any complaint, the police would receive the same and take action in accordance with law.

Having regard to the facts and circumstances of the case, this Court deems it appropriate to direct respondent No.4 that on the petitioner approaching him for lodging a complaint narrating his grievance, he shall accept the same and take action in accordance with law.

Subject to the above direction, this Writ Petition is disposed of.

Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
