THE HONOURABLE SRI JUSTICE C.V. BHASKAR REDDY Contempt Case No.2050 of 2014 ORDER:

This Contempt Case is filed by the petitioner alleging wilful disobedience of the order passed by a learned Single Judge of this Court in Writ Petition No.31518 of 2010, dated 21.06.2013.

Vide above order, this Court directed the petitioner to make appropriate application to the respondent-Authorities within three (03) weeks from the date of receipt of a copy of the order claiming compensation in respect of the petition schedule property, if it is taken over by the Municipal Corporation for the purpose of road-widening; and further, directed the respondent-Authorities to consider the said application within two (02) months from the date of receipt of copy of the application of the petitioner. 3.

Alleging wilful disobedience of the above order passed by the learned Single Judge, the petitioner has filed the Contempt Case against the respondents.

Learned counsel for the petitioner primarily contended that the respondents have not complied with the

above order, and they have also not paid compensation to the land as per the market value. He further submitted that the respondents have only paid compensation to the structures existing in the subject land, but they have failed to pay compensation as per the existing market value to the subject land.

On the other hand, Mr. N. Praveen Kumar, learned Standing Counsel for the Greater Hyderabad Municipal Corporation, appearing for the respondents, contended that taking into account the grievance of petitioner as regards compensation on par with market value to be paid with regard to the subject land, if the petitioner is still aggrieved, he is entitled to file appropriate cases before the competent civil court for claiming compensation. 6.

In view of above, this Court is of the considered view that petitioner is at liberty to take appropriate steps in accordance with law by approaching the competent Civil court by claiming compensation for the land as per the market value or by instituting a suit before the competent Forum.

It is needless to say that the respondents herein are also directed to dispose of the representation of the

petitioner, pending on its file, if any, as directed by the learned Single Judge vide above order; and if such representation is not found with the respondents, the petitioner herein is directed to make a fresh representation to the respondents within a period of one (01) week from to-day; thereafter, the respondents shall consider the representation of the petitioner within a period of six (06) weeks from the date of receipt of copy of the order, and pass a reasoned order strictly in accordance with law and communicate the same to the petitioner.

With these observations, the Contempt Case is closed. No costs.
