HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Civil Revision Petition No.3562 of 2017 Order:

The petitioner has come up with the above revision challenging an order passed by the trial Court under Order XXXII, Rule 3 CPC appointing the son as the guardian of the father on the ground that the father was deaf, dumb and mentally retarted.

2. Though Mr. Yallabandi Ramatirtha, learned counsel for the petitioner, contended that the father of the 3rd defendant is the 1st defendant in the suit and that without even producing him before the Court and examining him in a manner known to law, the trial Court passed the order, the order is nevertheless dated 10-7-2012. The petitioner has come up exactly after 5 years challenging the said order. Therefore, I do not wish to entertain the revision. Hence, it is dismissed. It will be open to the petitioner to raise all issues at the time of disposal of the suit. The miscellaneous petitions, if any, pending in this revision shall stand closed. No costs.
