THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE No.2946 OF 2015 ORDER:

This Criminal Revision Case is filed under Sections 397 and 401 of Cr.P.C. challenging the order dated 28.09.2015 passed in Crl.M.P.No.6886 of 2015 in C.C.No.655 of 2011 on the file of the Court of the Judicial Magistrate of First Class, Tiruvur. When the matter is taken up for hearing, the learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the criminal revision case with liberty to take the defences urged before this Court before the trial Court. He further submitted that the presence of the petitioner before the trial Court may be dispensed with.

Permission is granted.

Hence, the Criminal Revision Case is dismissed as withdrawn granting the liberty as prayed for. The presence of the petitioner, who is accused No.1 in C.C.No.655 of 2011, before the trial Court is hereby dispensed with on each and every date of adjournment. However, he shall appear before the trial Court as and when his presence is so required.
