HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.30792 OF 2018 ORDER :

This writ petition is filed challenging the action of the 3rd respondent in interfering with the civil disputes and in stopping construction activity in Plot No.44, North Part, in Survey No.60, Ward No.8, Block-3 of Shivaganga Hills, Karmanghat Village, Saroornagar Mandal, R.R.District, without any power or authority and without any complaint.

Learned Assistant Government Pleader for Home produced written instructions stating that on the complaint of one B.Kulender Reddy, against the petitioner and others, an entry was made in General Diary on 15.08.2018; that during preliminary enquiry both the complainant as well as petitioner and others were enquired; that as the said enquiry revealed that the subject matter is purely civil in nature, the complainant was informed to approach Civil Court. It is also stated that except causing enquiry, the respondent police have never interfered with civil disputes or prevented the petitioner from making constructions.

Recording the aforesaid written instructions submitted by the learned Assistant Government Pleader, the writ petition is disposed of directing the respondent police not to interfere with the civil disputes. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
