HON'BLE SRI JUSTICE S.V. BHATT W.P.No.11141 OF 2017 ORDER:
The petitioner seeks implementation of order of the Revenue Divisional Officer, Kurnool vide reference R.Dis.C.347/2016 dated 06.01.2017 in the instant writ petition.
The 4th respondent received notice and has filed counter affidavit. According to him, respondent No.5 filed revision before the Joint Collector, Kurnool and the revision in case No.Rc.D5.600/2017 is pending, therefore, the orders of Revenue Divisional Officer are not implemented. The counsel for petitioner submits that order of stay was not granted by the Joint Collector, still implementation could be effectively taken with the disposal of pending revision before the Joint Collector. She prays for a direction to the Joint Collector, Kurnool to consider and dispose of the case pending in file Rc.D5.600/2017 expeditiously. The learned Assistant Government Pleader does not oppose the request.
Hence the writ petition is disposed of by this order: (a) the petitioner to file representation before the Joint Collector, Kurnool by enclosing a copy of this order within four weeks from the date of receipt of the same, for expeditious disposal of the revision; and (b) the Joint Collector, Kurnool/Revisional Authority disposes of the revision as expeditiously as possible, preferably within three months thereafter after issuing notice to the contesting party as well.
There shall be no order as to costs.
