This petition is filed under Section 407 of the Code of Criminal Procedure, seeking transfer of C.C.No.314 of 2015 from the file of II Special Magistrate, Vijayawada, Krishna District, to the file of I Additional Chief Metropolitan Magistrate, Vijayawada.

Heard both sides.

It is submitted by the learned counsel for the petitioner that C.C.No.236 of 2013, which was originally filed before I Additional Chief Metropolitan Magistrate, Vijayawada, was transferred to the Court of II Special Magistrate, Vijayawada, and renumbered as C.C.No.314 of 2015; that C.C.Nos.258 of 2013, 108 and 109 of 2014 are pending on the file of I Additional Chief Metropolitan Magistrate, Vijayawada and came up for trial. Hence, seeks to transfer C.C.No.314 of 2015 also to the file of I Additional Chief Metropolitan Magistrate, Vijayawada to be tried along with the above cases.

In view of the above, C.C.No.314 of 2015 on the file of II Special Magistrate, Vijayawada, is hereby withdrawn and transferred to the file of I Additional Chief Metropolitan Magistrate, Vijayawada, to be tried along with C.C.Nos.258 of 2013, 108 and 109 of 2014 and decide the

same on own merits and pronounce judgment in all cases on the same day. Accordingly, Transfer Criminal Petition is allowed. Miscellaneous petitions pending, if any, shall stand closed. _________________________ Dr. B. SIVA SANKARA RAO, J Date:05-10-2015 pab
