HONOURABLE SRI JUSTICE N. BALAYOGI CRIMINAL REVISION CASE NO. 2348 OF 2018 O R D E R :

Heard Sri Narapa Reddy Yannam, learned counsel for the petitioner and the learned Public Prosecutor for the respondent No.3.

2. The present Criminal Revision Case is preferred against the impugned docket order dated 09/8/2018 passed in Crl.MP.No. 100 of 2017 in FCMC.No. 5 of 2015 by the Judge, Family Court-cum-IIIAdditional District and Sessions Judge, Srikakulam.

3. The contention of the learned counsel for the petitioner is that the petitioner has paid Rs.2,50,000/- and there remains only Rs.60,000/- . Because he is working as 'teacher' could not attend the Court on 09/08/2018. But as seen from the docket order, balance is Rs.90,000/-, however, the petitioner has agreed to deposit Rs.90,000/- and adjust the balance towards subsequent amount.

4. Even according to the petitioner, the amount due was Rs.3,10,000/- and he also filed calculation memo before the trial court and the petitioner filed Crl.MP.No.100 of 2017 in FCMC.No.5 of 2015 for recovery of maintenance of Rs.3,10,000/-.

Having regard to the facts and circumstances of the case and in view of the undertaking given by the counsel for the petitioner that he is going to deposit balance amount of Rs.90,000/- [Rs.Ninety Thousand only] as shown in the docket order, dated 09/8/2018, within four weeks from the date of receipt of a copy of this order, the Non-bailable

warrant issued by the trial court is recalled, failing which the order passed by this Court in this revision case stands vacated .

6. With the above direction, the Criminal Revision Case is disposed of.

7. As a sequel, miscellaneous petitions if any, pending in this Criminal Revision Case stands disposed of.
