ORDER:
This Writ Petition is filed for a Mandamus to declare the action of the respondents in seizing 170 quintals of rice in 680 bags, each containing 25 kgs, along with lorry bearing registration No.TN 34E 9655, as illegal and arbitrary.
A perusal of the record shows that the abovementioned stock along with the lorry was seized under a panchanama, dated 08.3.2009, wherein it is stated a case under Section 6-A of the Essential Commodities Act, 1955 (for short 'the Act') is registered.
Though the Writ Petition has been pending for six years, no counter-affidavit is filed and no information as to whether the case registered under Section 6-A of the Act was disposed of or not is forthcoming. However, as
the respondents have to take the seizure to its logical end, it is reasonable to presume that the case was disposed of in view of long lapse of time.
On this premise, the Writ Petition is disposed of as infructuous.
