THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.2973 OF 2016 ORDER:

Heard the learned counsel for the petitioner/A.3 and the learned Public Prosecutor.

2. The petitioner, who is accused No.3 in Sessions Case No.658 of 2013 on the file of the Additional Metropolitan Sessions Judge, Cyberabad at L.B.Nagar, Ranga Reddy District, filed the present Criminal Petition seeking enlargement on bail.

3. A charge sheet came to be filed against the petitioner and others for the offences punishable under Sections 302, 201 read with 109, 212 Part-I of the Indian Penal Code, 1860.

4. Today when the matter is taken up for hearing, the learned Public Prosecutor submitted across the Bar that the trial in the case has commenced today and it will be completed at the earliest. He submits that if the petitioner is released on bail at this stage, there is every likelihood of he evading the process of trial.

5. A perusal of the material on record show that earlier the petitioner herein was granted bail and on a particular date when he failed to appear before the trial Court, Non-Bailable Warrant was issued. In spite of the same, the petitioner did not attend the Court nor taken steps to recall the same immediately. On 11.03.2015 he is said to have been remanded to judicial custody.

6. Having regard to the circumstances stated above and since the trial has commenced, the request of the petitioner cannot be considered at this stage and is liabale to be rejected. However,

the trial Court is directed to complete the trial as early as possible preferably within a period of three (03) weeks from the date of receipt of a copy of this Order.
