This Company Petition is filed under Section 433(e), (f), 434(1)(a), 434(1)(c) and 439(1)(b) of the Companies Act, 1956, seeking winding up of respondent-company (M/s Samyu Glass Pvt. Limited). Heard Ms. K. Annapurna Reddy, learned counsel for the petitioners; and Sri T. Balamohan Reddy, learned counsel appearing for the respondent. It is a creditor's winding up petition. Evidence also recorded. At this stage, it is brought to the notice of the Court that CP(IB) No.153/7/HDB/2019, under Section 7 of IBC, 2016 r/w Rule 4 of I&B (AAA) Rules, 2016, is filed by the Financial Creditor (Andhra Bank, SCF Branch, Hyderabad), before the National Company Law Tribunal, Hyderabad Bench, and same is pending, and the Company Petition also stands admitted.

In those circumstances, giving liberty to the petitioners in this Company Petition to make claim before the Interim Resolution Professional (IRP), namely, Shri Sreenivasa Rao Ravinuthala, the company petition is closed.
