THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.33934 of 2011 ORDER:
When the matter is called, it is submitted by learned counsel for the petitioner so also learned Standing Counsel for the respondent-Corporation that the issue in the present writ petition is squarely covered by the order, dated 24.04.2018, in W.P.No.32850 of 2018 and batch, of this Court. A copy of the same is placed on record.
Following the said order and for the reasons stated therein, this writ petition is also disposed of, directing the respondentsCorporation to consider the explanation submitted by the petitioner pursuant to the notice issued under Section 452 of the Greater Hyderabad Municipal Corporation Act, 1955 and pass appropriate Orders within a period of eight weeks from the date of receipt of a copy of this Order. If the petitioner has not submitted the explanation, he may do so, within three weeks from the date of receipt of the order copy. It is needless to observe that until such orders are passed, the respondents-Corporation is directed not to take any coercive steps to demolish the structures raised by the petitioner in his premises.
It is also observed that under the guise of pendency of passing of the said orders by the respondentsCorporation, the petitioner cannot proceed with further constructions. If the construction made by the petitioner is within the parameters of the Orders issued by the Government for regularization of the building, the same may also be considered by the respondent-Corporation, while passing the Orders. There shall be no order as to costs.
Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
