THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.5911 OF 2017 ORDER :

Heard. With the consent of both counsel, the writ petition is disposed of at the admission stage.

Earlier the request of the petitioner for including his name in the list of land loosers in accordance with the orders in G.O.Ms.No.98 dated 15.04.1986, was rejected on the ground that petitioner has not submitted the application within one year from the date of actual displacement. Praying to review the said decision, petitioner submitted Review petitions on 16.11.2015 and 14.03.2016.

Learned counsel for the petitioner contended that the very same District Screening Committee, earlier condoned the delay in submission of applications and names were included. Therefore, not considering the application of the petitioner on that ground is erroneous.

Since Review petitions are pending, District Selection Committee is directed to consider the said review petitions in the light of earlier decision in Rc.No.CC/08/2012 dated 27.11.2012 of the office of Collector & District Magistrate, Khammam and pass orders within a period of three (3) weeks from the date of receipt of copy of this order. Till a decision is made on the review petitions and having regard to the fact that earlier the delay was condoned, this Court is also inclined to direct respondents 1 to 3 to keep one post of Junior Plant Attendant/Security guard vacant.

With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
