HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13985 OF 2015 ORDER:

This criminal petition under section 438 of the Code of Criminal Procedure is filed by the petitioners-accused seeking anticipatory bail in connection with F.I.R. No.77 of 2015 pending on the file of S.H.O., Mellacheruvu Police Station, Nalgonda District registered for the offence under Sections 465, 468, 471 and 420 IPC. The allegation against the petitioners herein is that the first petitioner has forged the signatures of revenue officials, fabricated the pattadar and title deed pass book in respect of certain extent of land and basing upon the same, she has gifted the property in favour of second petitioner herein.

Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor.

It is the case of the petitioners that they are the genuine owners of the property in question and that aggrieved by the cancellation of pattadar passbook, they have also preferred a revision before the revenue authorities.

Considering the above, this Court is inclined to grant anticipatory bail to the petitioners herein.

Hence, the petitioners-accused are directed to surrender before the Magistrate concerned on or before 02.02.2016 and on such surrender, they shall be enlarged on bail on each of them executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety each for the likesum to the satisfaction of the Magistrate concerned. Further they are directed to report before the Station House Officer concerned as and when required. Accordingly, the Criminal Petition is allowed.
